Hayley Lehmann Ltd is a company incorporated in England and Wales, registered number 04710957. Registered office address is: The Den, 2 Dingle Close, Arkley, Hertfordshire, EN5 3EL.

We are Data Protection registered with Information Commissioners Office (ICO) registration number Z8135382 and have been registered since 2003.

Hayley Lehmann Ltd undertakes business in the following areas:

  • Taking photographs, producing images for schools’ data bases and selling photographs to parents.

  • The software which we have developed to facilitate the school photography process is licensed to other photographers to use. These photographers are our customers.

  • Hayley Lehmann also trades as a portrait & event photographer, sound recording artist and creates and sells fine art to the general public.

2. How and why we collect information

Hayley Lehmann Ltd will collect and use personal information from you if:

You are a school who commissions us to photograph your pupils – either for your database or to sell photographs to parents. We will collect your name and contact details so that we can serve you.

You come to our website to view photographs. We will ask for your email address when entering your unique password and pre-populate our order form to speed up the checkout process. We also use it if you leave the website without placing an order, in order to remind you the next day that you haven’t ordered. This assists users who incorrectly think they have completed the sales ordering

process. Your email address is not used for any other purpose unless you explicitly tick a box agreeing to sign up to our newsletters.

If you place an order for photographs, this will include your name and your child’s name, address, telephone number and email address to enable us to deliver the prints you have requested direct to your home address or school.

If you are a school photographer who uses our Pics Checkout software, we will collect your name and contact details so that we can serve you.

If you book Hayley Lehmann to do portrait & event photography, a sound recording or buy fine art we will collect your name and contact details so that we can serve you.

The information we hold about you could also be used to resolve any problems you may have with our service.

3. Sharing your information

There are certain circumstances under which we may disclose your personal information to third parties.

For instance Hayley Lehmann Ltd’s websites are hosted by Namesco and their administrators may occasionally help us with issues on our websites.

We require all third parties to respect the privacy of your personal information and to treat it in accordance with the law. We have checked that they are GDPR compliant.

When someone visits our sites Google Analytics collects standard internet log information and details of visitor behaviour patterns. This information is only processed in a way which does not identify anyone. We do not make, and do not allow Google to make, any attempt to find out the identities of those visiting our website. Our websites ask for a login code to view school photographs. After logging in, the cookie is functional for keeping track of various things such as a basket id or whether you are logged in.

5. Marketing

We are subject to certain rules and privacy laws when marketing to our customers. For example, a Data Subject’s prior consent is required for electronic direct marketing (for example, by email, text or automated calls). The limited exception for existing customers known as “soft opt in” allows organisations to send marketing texts or emails if they have obtained contact details in the course of a sale to that person, they are marketing similar products or services, and they gave the person an opportunity to opt out of marketing when first collecting the details and in every subsequent message.

The right to object to direct marketing must be explicitly offered to the Data Subject in an intelligible manner so that it is clearly distinguishable from other information.

6. Your information

Personal data that we process for any purpose shall not be kept for longer than is necessary to provide our services. Data used when making sales will be kept for six years in keeping with Inland Revenue guidance.

You are entitled to view, amend or delete the personal information that we hold. Subject Access Requests from individuals should be made by email, addressed to the Data Controller, Hayley Lehmann at Hayley@hayleylehmann.co.uk

The Data Controller will provide the relevant data within 28 days.

The identity of anyone making a subject access request will always be verified before handing over any information.

You will not have to pay a fee to access your personal information (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

7. Payment

The most convenient way for you to pay for photographs from our websites is by secure on-line credit card payment. To facilitate this, our sites contain a link to Stripe, our chosen Payment Gateway. When you have placed your order and are required to make payment, you are transferred to

the Stripe site, which means we do not process your financial information and therefore are not able to store it. Your payment, using the Stripe system, is transacted through their secure server software, which encrypts all information so it cannot be intercepted.

8. System Security

We are committed to ensuring that your information is secure.

In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and other procedures to safeguard and secure the information we collect online and from our customers. We cannot publish full information on security as the information is confidential to the company and disclosure would pose a security risk.

9. Changes to our privacy policy

We may change our privacy policy from time to time. We will always update the privacy policy on our websites, so please try to read it whenever you visit. This policy is effective from 25 May 2018

10. Further Information

Personal data in the European Union is protected by data protection laws but other countries do not necessarily protect your personal data in the same way.

Personal data used by us will never be transferred outside the European Economic Area.
